Simple summary

By purchasing from Fernando’s Winehouse, the customer accepts these terms. Orders depend on confirmed payment, stock availability, shipping rules, applicable legislation and any import restrictions in the destination country.

Scope

These General Terms regulate the terms and conditions for using the online store of Fernando’s Winehouse Unipessoal, Lda., located at Estrada Nacional No. 1, No. 737, 4535-214 Mozelos, Portugal.

The purchase of any product from the Fernando’s Winehouse online store implies acceptance of these General Online Sales Terms.

All alcoholic beverages available for sale may only be purchased by persons who are of legal age to do so in their country of residence.

Products, prices and content

Fernando’s Winehouse reserves the right to modify, without prior notice, information about products, prices, promotions, commercial conditions and services.

Product images may differ from the product delivered and products are subject to stock availability.

Despite our efforts, pricing errors may occur. Before processing the order, values may be checked. If there is a relevant discrepancy, the customer will be informed and may accept the new value or cancel the order.

Unless otherwise stated, the prices shown include the applicable VAT rates under Portuguese law.

Orders and payment

After order confirmation, an email will be sent to the address provided by the customer with delivery, billing, payment, product and price details.

The customer must check all order details. If any error is detected, the customer should contact Fernando’s Winehouse as soon as possible, provided the order has not yet been shipped.

Orders will only be processed after effective receipt of payment. Placing an order does not, by itself, constitute a definitive reservation of the products.

If an order cannot be fulfilled in whole or in part, the customer will be contacted to find the most suitable solution.

Orders may be cancelled when requested by the customer before dispatch.

Payment methods

The online store may provide different payment methods, including card, bank transfer, PayPal, Multibanco, MB WAY or other methods shown at checkout.

Certain payment methods may be available only in specific countries or subject to the conditions of the relevant payment provider.

The order will be processed according to the payment status received by Fernando’s Winehouse or by the relevant payment provider.

Order statuses

Orders may have, among others, the statuses pending payment, processing, in transit, delivered, cancelled or any other status necessary for managing the purchase.

Pending payment means that payment has not yet been confirmed. Processing means that payment has been received and the order is being prepared. In transit means that the order has been shipped. Delivered means that the order has been delivered to the customer.

Shipping costs

Shipping costs are added to product prices, where applicable.

Shipping costs are calculated based on factors such as destination, weight, quantity, packaging, carrier and commercial conditions applicable at the time of the order.

The final shipping cost is shown in the cart or checkout before order confirmation. These amounts may change without prior notice.

Shipping and deliveries

Orders may be sent to the address provided by the customer or, where available, collected at Fernando’s Winehouse premises.

The delivery times indicated are estimates and may vary depending on destination, carrier, customs, order volume, weather conditions or other factors outside Fernando’s Winehouse’s control.

After dispatch, the customer may receive order tracking information, where available.

The customer must track the shipment and ensure that the address provided is correct and accessible for delivery.

Receipt, damage and non-conformities

All products must be checked upon delivery.

If the order shows visible damage, the customer must report the situation to the carrier at the time of delivery and contact Fernando’s Winehouse as soon as possible.

If, after delivery, the customer finds that any item is not in conformity, they must contact us at geral@fernandoswinehouse.pt, stating the order number and attaching photos of the packaging and the items received.

Legal restrictions, customs and import

Fernando’s Winehouse is not responsible for orders sent to countries where legislation does not allow the entry of alcoholic beverages or imposes specific restrictions on their import.

It is the customer’s responsibility to ensure that the products can be legally imported into the destination country.

Customs fees, import duties, clearance costs or other local charges, where applicable, are the customer’s responsibility unless expressly stated otherwise.

In-store collection

Where available, the customer may select collection from Fernando’s Winehouse premises, located at Estrada Nacional No. 1, No. 737, 4535-214 Mozelos.

The order may only be collected by the person indicated in the order, unless the customer gives prior notice authorising another person.

The customer must wait for confirmation that the order is available before travelling to our premises.

Returns

Fernando’s Winehouse recognises customers’ right of withdrawal and return under applicable law.

To request a return or exchange, the customer must contact Fernando’s Winehouse at geral@fernandoswinehouse.pt, stating the order number or associated document.

Products must be in perfect condition, unused, with original packaging, accessories or promotional gifts included where applicable, and accompanied by proof of purchase or invoice.

After receipt and validation of the condition of the goods, the appropriate solution will be found, including refund, replacement or another previously agreed solution.

Defective products or incorrect shipments

In the event of a defective product or incorrect shipment attributable to Fernando’s Winehouse, the circumstances will be analysed and, when confirmed, a solution will be presented at no additional cost to the customer.

Fernando’s Winehouse will not accept returns of products that have been used, altered, modified or damaged due to incorrect use, negligence, poor storage conditions or force majeure.

Applicable law and dispute resolution

All purchases made on the Fernando’s Winehouse website are subject to Portuguese law.

Any conflict or divergence in the interpretation of these General Terms shall be submitted to the competent Portuguese courts.

Under applicable law, the available Alternative Dispute Resolution entity is the Porto Consumer Conflict Arbitration Centre.
