Conditions of Use
1. Object
1.1 These General Conditions in force, updated in October 2017, are intended, with the order form, and the other elements referred to therein, to regulate the terms and conditions by which the provision of the Online Shop Service of Fernandos Winehouse unipessoal ldª., with headquarters at Estrada Nacional n.º 1, will be governed, no. 737, 4535-214 Mozelos, with the unique registration and identification number of legal person no. 514353244, with a share capital of 1500 € (euros), hereinafter referred to as Fernando's Winehouse.

1.2 The purchase of any product in the Fernando's Winehouse Online Store implies the acceptance of these General Conditions of Sale Online.

1.3 Any and all alcoholic beverages available for sale in the Fernando's Winehouse Online Store can only be purchased by people who are of legal age to do so, in their country of residence.

2. Product Information, Prices and Contents

2.1 Fernando's Winehouse reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.

2.2 The images that illustrate each product in Fernando's Winehouse may differ from the product subsequently delivered, being also subject, these same products, to the rupture of stock.

2.3 Despite the efforts of Fernando's Winehouse, some products of the online store, may present an inaccurate price, reason before proceeding to the processing of the orders, all values are verified. Thus, the prices shown at Fernando's Winehouse are merely indicative and do not constitute a contractual offer. If the actual price of the product is lower than the advertised price, Fernando's Winehouse will refund the difference. If the price is higher, Fernando's Winehouse will inform the customer of such situation by e-mail and will await his decision to accept the new price or cancel the order within 15 days from the date on which the e-mail was sent.

2.4 Under Portuguese law, all prices shown at Fernando's Winehouse include the respective VAT rates in force, unless otherwise stated.

3. Order and Payment

3.1 After the confirmation of the order at Fernando's Winehouse, an e-mail will be sent to the contact address registered in the same by the customer at the time of formalization, with all the details about the delivery, billing, payment information, products and values. Fernando's Winehouse suggests to all customers the confirmation of the details of the same. If the customer does not receive the order confirmation e-mail it is requested to contact Fernando's Winehouse through the contacts available on the fernandoswinehouse.pt website, so that this notification is again sent to the customer's e-mail address.

3.2 If any of the details placed by the customer in the order are wrong and / or the customer wishes to change any information, provided that the order has not yet been shipped, it is requested that the customer contact Fernando's Winehouse through the contacts available on the website fernandoswinehouse.pt as soon as possible so that internally the change requested by the customer is made. Changes to the details of orders already shipped will have to be analyzed by the Fernando's Winehouse team so that, together with the customer, a more appropriate solution can be found.

3.3 All orders at Fernando's Winehouse will only be processed after the actual receipt of payment. The formalization of the order only in itself does not constitute a reservation of the products.

3.4 If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by Fernando's Winehouse in order to find the most appropriate solution.

3.5 All orders placed at Fernando's Winehouse have a maximum payment term of 15 days. At the end of this period, the order will be automatically cancelled.

3.6 Orders may be cancelled when expressly requested by the customer through the contacts available on the fernandoswinehouse.pt website, before the shipments of the orders. After confirmation of the shipment of the order, the customer is asked to contact Fernando's Winehouse so that, together with it, the most appropriate solution can be found.

3.7 Through the Fernando's Winehouse Online Store, payments are accepted through Multibanco Reference (only for customers with a bank account in Portugal), Bank Transfer, Paypal and Boleto Bancário (the last for customers residing in Brazil).

3.8 To orders paid through Paypal and Boleto Bancário, payment fees are automatically added, in the amounts of:

a) 3% for payments made through Paypal.

b) 6% for payments made by Boleto Bancário.

3.9 The states of the orders at Fernando's Winehouse are comprised in 3 phases: Pending, In Processing and Finalized.

a) Pending – Awaits the entry of the payment in the Fernando's Winehouse system;
b) In Processing – Phase in which the payment has already been received, and the order is in processing and in packaging / preparation;

c) Finalized – The order has already been shipped/sent.

4. Shipping costs

4.1 To the prices shown on the products is added the respective value of the postage, to each order, which are calculated based on the sum of two factors: the cost of packaging and the cost of transport. The packaging cost for each bottle is 2 € (euros). The shipping cost depends on the weight of the order and its delivery destination. This value of the postage can be simulated inside the shopping cart with the intended products added and filling in all the requested fields of the simulator. The total postage will also be automatically calculated when placing your order in the Online Store. It should be noted that the factors of this calculation may be variable and undergo changes without prior notice.

5. Shipments and Deliveries/Pick-up at Fernando's Winehouse warehouse

5.1 For orders to be sent to the requested address, the shipping option must be chosen – National Shipping (in case of Portugal) and International Shipping (in case of other countries outside Portugal).

5.2 In general, after shipment, an order at Fernando's Winehouse takes a long time to be delivered
– 72 hours in mainland Portugal;
– Between 5 to 9 business days in the Islands of Madeira and Azores;
– About 4 business days in Peninsular Spain;
– About 6 business days in the rest of Europe;
– Approximately 7 business days in the rest of the world.

5.3 After the shipment of the orders, the information for monitoring the shipment will be available in the account of the customers who have placed the order with registration and a notification is also sent via e-mail with the information of the link to monitor the shipment for all registered and unregistered customers. If for some reason the customer does not receive the shipment confirmation it is requested to contact Fernando's Winehouse through one of the contacts available on the website fernandoswinehouse.pt so that all available information about the shipment of the order is sent again.

5.4 After the shipment notification, customers must follow the status of the shipment through the link provided by Fernando's Winehouse, so that they are aware of the state of evolution until the moment of delivery of the order, since Fernando's Winehouse does not notify each change of status of the shipment.

5.5 All products sent by Fernando's Winehouse must be verified at the time of delivery. If the customer finds that the order is damaged, he must return it immediately to the transport company, duly justify the reason for the return on the carrier's packing slip and immediately notify Fernando's Winehouse through one of the contacts available on the website fernandoswinehouse.pt.

5.6 If after delivery, the customer verifies that any of the articles is not in conformity, it is requested that he immediately contact Fernando's Winehouse through the e-mail [email protected] indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all the articles, so that internally the process of investigation of the occurrence is opened and thus the situation can be solved with as soon as possible.

5.7 Fernando's Winehouse is not responsible for shipments made to countries in which the respective law does not allow the entry of alcoholic beverages. It is the responsibility of the customers the eventual seizure of their orders, as well as the payment of customs fees, if they exist. In case of return of the products Fernando's Winehouse will refund only the amount corresponding to these same products. In case of doubts, the customer may contact Fernando's Winehouse before ordering.

5.8 Fernando's Winehouse has contracted services with specialized carriers for the purpose of deliveries in Portugal, Europe and most countries of the World. Every effort is made to comply with the shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be of a nature unrelated to Fernando's Winehouse, and it is not possible, in these cases, to guarantee exact delivery times.

5.9 Most deliveries are made during office hours on working days at the shipping address indicated by the customer when he submitted the order.
< br>5.10 In case of attempted delivery by the transport company without success due to absence, a notice of passage is always left in the customer's mailbox with the indications of the carrier. Depending on the service and the carrier, the orders must be collected at the place indicated by it in the transit notice, or the indications requested in the same notice must be followed.

5.11 If for some reason the customer cannot receive the order or pick it up at the place indicated by the carrier, the customer is requested to contact Fernando's Winehouse so that together the most appropriate solution can be found.

5.12 Before submitting the order, if the customer wishes to pick it up at our warehouse, he must select the shipping option ''Pick up at the Store'' – our physical facilities located on Estrada Nacional n.º 1, n.º 737, 4535-214 Mozelos.

a) will be automatically assumed to pick up the order, unless you notify Fernando's Winehouse in advance that another person (identifying the name) will pick up the order.
b) Orders for in-store pickup may take 1 business day to be processed, all customers are notified via e-mail when they are available to be collected.
c) When going to the physical facilities of Fernando's Winehouse, The customer must follow the confirmation / order number, ensuring that he has received our order confirmation notification available for pickup, and thus avoid unnecessary travel.

6. Returns

6.1 Fernando's Winehouse recognizes to all its customers the right to terminate the contracts they enter into with it, allowing them to return, within 14 (fourteen) days, the products purchased pursuant to Decree-Law no. 143/2001 and Decree-Law 82/2008 of 20/05.

6.2 To request an exchange or return, The customer is requested to contact Fernando's Winehouse through the e-mail [email protected] indicating the order number or the number of the document that accompanied the order, taking into account the conditions described below in the following topics:

a) To return the order, the product must be in perfect condition, and if applicable with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.
b) The return of defective products and erroneous shipments will be admitted, and Fernando's Winehouse will be responsible for the shipping and collection costs whenever the customer communicates this circumstance within 14 (fourteen) days from the date of receipt of the product.
c) Once received the merchandise in our facilities and after validation of the condition of the same in conformity, will proceed to the return of its value according to the mode of payment made by the customer, or another solution previously agreed with the same.

6.3 Fernando's Winehouse assumes responsibility arising from defects of origin or raw material of the product purchased and if this is confirmed by the specialized team of Fernando's Winehouse will exchange or return the product at no cost to the customer.

6.4 Fernando's Winehouse will not accept the return of the product after it has been used, or in case it has been altered or modified.

6.5 Fernando's Winehouse is not responsible for the deficiencies resulting from the incorrect use, negligence, poor storage conditions or causes of force majeure.

7. Applicable Law

7.1 All purchases made on the Fernando's Winehouse website are subject to Portuguese law. Any conflict or divergence of interpretation of the General Conditions of Online Sale will be submitted to the competent Portuguese Court.

7.2 If the Customer is outside mainland Portugal, Fernando's Winehouse hereby informs that any judicial proceedings must be exclusively instituted in the Portuguese Courts.

7.3 Under the terms and for the purposes of the provisions of article 18 of Law no. 144/2015, of September 8, it is informed that the ADR entity available is the Center for Arbitration of Consumer Conflicts of Porto, with the following contacts:
